Re:Designated Suppliers Program

As you know, in December, the US Department of Justice issued a favorable Business Review Letter for the Designated Suppliers Program (DSP). As we reported to you then, based on guidance provided by the DOJ as part of the Business Review process, we have made modest revisions to the proposed program. A new DSP description is now available; you can access it here. As we noted in December, in light of the DOJ’s decision, universities may implement the DSP standards and requirements with the knowledge that doing so is consistent with antitrust law.

You might also find of interest the following statements/reports on the DOJ’s approval of the program:

  • Statement by US Senator Pat Leahy, Chairman of the Senate Judiciary Committee
  • Report in the Chronicle of Higher Education
  • Analysis by Trade Regulation Talk, a prominent blog on commercial and antitrust law

As always, please contact us with any questions or thoughts about this information.
