The WRC’s investigation of PT Mulia Knitting was triggered by a worker complaint alleging serious violations of worker rights in the area of freedom of association.

New Holland

At the time the WRC received the New Holland complaint, workers had recently organized a labor union to try address what they viewed as labor rights violations: the workers alleged verbal harassment of workers, forced overtime, and unclean restroom facilities, among other problems. The primary subject of the complaint was that the company had allegedly tried to eliminate the worker organization from the factory by illegally firing its founding leaders.

New Wide Garment Cambodia

The WRC’s assessment of New Wide Garment, initiated in October of 2007, identified a number of serious labor rights violations in the areas of freedom of association, women’s rights, wages and benefits, and occupational health and safety. Significant progress has been achieved.

Chong Won Fashion, Inc. (C. Woo Inc.)

In response to a worker complaint, the WRC launched an investigation into alleged labor rights violations at Chong Won in late October, 2006. The investigation found serious and ongoing labor rights violations at Chong Won, including minimum wage violations, forced overtime, violations of workers’ right to unionize and bargain collectively, and, of particular concern, collusion by factory management with government agents in violence against workers engaged in a lawful and peaceful strike.

PT Sarasa

The WRC chose to initiate the assessment when it learned that the factory had engaged in a lock-out of employees during the course of annual wage negotiations with the union that represents the plants workers, known as FSBKU. Subsequent to the lock-out and the initiation of the WRC’s assessment, PT Sarasa management announced that the facility would be shut down permanently. The WRC’s investigation found strong evidence supporting the conclusion that the lock-out and subsequent mass termination were motivated by anti-union animus, as a measure to retaliate against workers for the exercise of protected associational rights.

PT Panca Brothers Swakarsa

After the vast majority of former workers were reemployed at PT PBS, after a constructive relationship between management and worker representatives was established, and after management expressed a willingness to resume contract negotiations with the union once business stabilized, the WRC was optimistic that a high degree of compliance could be achieved at this factory. Unfortunately, PT PBS management has not followed through on its commitment to respect its employees’ rights of association.

PT Panarub

Based upon information from Adidas, OCAA, local non-governmental organizations, and our own preliminary research, the WRC identified a number of areas of concern for investigation. These included: Legally Mandated Benefits; Freedom of Association; Occupational Health and Safety; Psychological and Physical Abuse of Employees; Arbitrary Firings and Forced Resignations; Hours of Work and Wages; Use of the Contract Labor System, and the Imposition of Improper Expenses on Workers.

Paxar

The WRC has identified serious and clear-cut violations of Turkish law and applicable codes of conduct at Paxar’s Turkey facility. The key outstanding violations include the factory’s refusal to reinstate a group of workers whom the company terminated illegally in retaliation for the workers’ association with a trade union, and the factory’s refusal to recognize and negotiate in good faith with the trade union which has been authorized under Turkish law to negotiate with the company on behalf of its members.

The primary issue of concern at the factory has been violations of workers’ associational rights, including illegal firings of trade union members and threats against union supporters. Additional violations that have been uncovered in the course of the WRC’s work at the factory include forced overtime, discrimination against pregnant workers, and failure to pay workers on time and other payroll irregularities that have the effect of denying workers full payment for hours worked, among other issues. We are pleased to report that there has been very significant progress in addressing these issues, thanks in large part to efforts by Gap.

Gildan El Progreso S.A. (Gildan Activewear)

In January 2004, the WRC received a complaint from the Maquila Solidarity Network (a Canadian non-governmental organization) supported by the Federación Independiente de Trabajadores Hondureños (FITH, Independent Federation of Honduran Workers) and Canadian Labour Congress, on behalf of a group of workers alleging labor rights violations at Gildan El Progreso.
